¿Qué es el “deber de cuidado”?

Esto incluye a los dueños de perros, administradores de propiedades, conductores e incluso ciclistas. Ciertos grupos de personas se adhieren a diferentes niveles de responsabilidad, y si no cumplen con ese estándar, la ley los encontrará negligentes. Los estándares profesionales se establecen con el fin de aclarar, en la medida de lo posible, cuándo una persona es negligente versus cuándo está actuando razonablemente. Estos estándares pueden ayudar a distinguir entre circunstancias incontrolables y personas incompetentes, o actos de Dios frente a acciones imprudentes.

Por ejemplo, los médicos a menudo tienen que cumplir con los más altos estándares de atención porque brindan servicios de tratamiento de manera explícita. Si alguien sufre daños bajo su cuidado porque actuó de una manera que un médico no debería, la ley los hará responsables. Las empresas de camiones, de manera similar, deben asegurarse de que sus conductores estén seguros y descansados para evitar accidentes; esto demuestra que las partes que son indirectamente responsables aún pueden rendir cuentas.
