¿Qué determina quién tiene la culpa en un accidente de tráfico?

En Texas, al igual que en todos los demás estados, existe un conjunto de reglas oficiales que dictan cómo se supone que debe conducir. Sin duda, cualquier persona con una licencia de conducir de Texas está familiarizada con muchas de estas reglas, pero muchas personas las violan intencional y accidentalmente todos los días.

Cuando ocurre un accidente, las compañías de seguros analizarán las circunstancias del choque para ver si uno de los conductores tiene la culpa. Por ejemplo, si un conductor pasa una luz roja, casi siempre tiene la culpa del choque. En otros accidentes, sin embargo, la culpa no es inmediatamente obvia. ¿Qué es la negligencia?

Para probar negligencia en un accidente, primero debe probar que el otro conductor tenía la obligación de usar un estándar ordinario de cuidado. Esencialmente, este es el grado de cuidado que una persona de prudencia ordinaria usaría en circunstancias similares. Los conductores tienen la obligación implícita de permanecer seguros en la carretera, y el Código de Transporte de Texas define claramente esta responsabilidad, por lo que generalmente es fácil de probar para un abogado.
